Kazakhstan Amends CFC Rules with Temporary Exemption for Treaty Countries

Kazakhstan published Law No. 241-VІ ZRK in the Official Gazette on 3 April 2019 including several amendments and additions to various legislative acts in order to improve the business environment in Kazakhstan. With respect to taxation, one of the main amendments is to the controlled foreign companies (CFC) rules to provide that the rules will not apply in respect of entities resident in jurisdictions with which Kazakhstan has entered into a tax treaty. This exemption from the CFC rules applies retroactively from 1 2018 but is only temporary and is to expire on 1 January 2020.
