Peru Amends Tax Haven Regulations to Exclude OECD Countries

Peru's Ministry of Economy and Finance has published Supreme Decree No. 007-2018-EF, which amends the regulations concerning low and no tax jurisdictions (tax havens) to provide that no member country of the OECD will be considered as a tax haven. The Decree enters into force on 1 January 2019. Dealings with residents of jurisdictions considered tax havens are impacted by certain tax rules, including Peru's CFC rules, transfer pricing rules (whether related not), and expense deduction rules.
