Malta has published Act No. IX of 2025 in the Official Gazette, which provides for the implementation of the Budget Measures for the Financial Year 2025 and other administrative measures. With respect to income tax, one of the key measures of the Act is the introduction of new provisions for an "Elective Tax" that effectively allows for the introduction of Pillar 2 top-up taxes on an elective basis. As an EU Member State, Malta is required to transpose the provisions of Council Directive (EU) 2022/2523 of 14 December 2022 for the introduction of the Pillar 2 global minimum tax rules....
