Hungary has published Decree 19/2020 (XII. 30.), which provides the list of non-cooperative jurisdictions in relation to Hungary's new controlled foreign company (CFC) defensive measure. The measure, which applies from 1 January 2021, provides that certain exemptions from the CFC rules may not be applied in relation to foreign companies established in a non-cooperative jurisdiction. As expected, the list provided by the decree follows the EU list of non-cooperative jurisdictions and includes: American Samoa, Anguilla, Barbados, Fiji, Guam, Palau, Panama, Samoa, Seychelles, Trinidad and Tobago, the US Virgin Islands, and Vanuatu.
